INVESTIGATION OF THE NEW YORK STATE COMMISSION OF CORRECTION TO DETERMINE ITS SUCCESS IN IMPLEMENTING PROVISIONS OF A STATUTE WHICH RESTRUCTURED THE COMMISSION IN 1974.
Abstract
THE INVESTIGATION WAS UNDERTAKEN IN RESPONSE TO A REQUEST BY THE GOVERNOR TO INQUIRE INTO THE CONDUCT OF STATE COMMISSION OF PERFORMANCE OF OFFICIAL DUTIES AND TO EXAMINE THE ACTS AND OMISSIONS OF SUCH OFFICERS AND EMPLOYEES CONCERNING INFORMATION COMMUNICATED TO THEM REGARDING CONDITIONS AT THE DUTCHESS COUNTY JAIL. ALL PERTINENT BOOKS, RECORDS, MINUTES, REPORTS, AND DOCUMENTS OF THE STATE COMMISSION OF CORRECTION (SCC) WERE REVIEWED AND KEY STAFF MEMBERS EXAMINED AT PRIVATE HEARINGS. IN ADDITION, PERSONS POSSESSING MATERIAL INFORMATION WERE INTERVIEWED IN THE FIELD AND TRANSCRIPTS OF PUBLIC HEARINGS WERE STUDIED. THE COMMISSION FOUND THAT INCUMBENT COMMISSIONERS HAD FAILED TO FULFILL THEIR STATUTORY OBLIGATIONS. RECOMMENDATIONS ARE MADE TO ESTABLISH AN EFFECTIVE METHOD FOR RECEIVING AND ACTING UPON ALLEGATIONS OF MISMANAGEMENT AND TO REVISE AND UPDATE SCC MINIMUM STANDARDS.
