THIS REPORT REVIEWS FEDERAL AND STATE LEGISLATION ON SERIALLY NUMBERED PROPERTY AND OUTLINES A MODEL STATUTE WHICH WOULD REQUIRE A UNIFORM SYSTEM OF NUMBERING ALL MANUFACTURED GOODS SOLD WITHIN A STATE.
Abstract
THE MODEL STATUTE ALSO PROVIDES PENALTIES FOR ALTERING OR DESTROYING SERIAL NUMBERS, AND FOR THE KNOWING POSSESSION OF GOODS ON WHICH SERIAL NUMBERS HAVE BEEN ALTERED OR DESTROYED. IT WAS FOUND THAT AT PRESENT THE NUMBERING OF MANUFACTURED ITEMS IS, IN MOST CASES, A VOLUNTARY AFFAIR. IN RELATIVELY FEW CASES, HOWEVER, MANUFACTURERS ARE REQUIRED BY LAW TO PLACE SERIAL NUMBERS ON SPECIFIC KINDS OF PRODUCTS. THE LANGUAGE OF THE PROPOSED MODEL STATUTE IS DESIGNED FOR STATE LEVEL ENACTMENT, BUT WITH MINOR MODIFICATIONS IT COULD SERVE AS A BASIS FOR A FEDERAL PROGRAM. THE ISSUE OF STATE BURDENS ON INTERSTATE COMMERCE UNDER THE MODEL STATUTE IS ALSO DISCUSSED.
