In January 1989 the Criminal Justice Branch of the Ministry of the Attorney General of Canada created the position of Executive Crown Counsel for Native Justice Issues to examine existing models of diversion, make recommendations for changes, and consider establishing pilot diversion projects for native communities in Canada.
Abstract
The effort resulted from recognition of the need to address the disproportionate representation of natives in the criminal justice system. It also rests on the recognition that any variation from traditional criminal justice procedures requires the unqualified support of the native communities involved. The program aims to improve the delivery of justice in the existing justice system; encourage disclosure of more offenses, particularly spousal abuse and sexual offenses; and provide a process that emphasizes offender and victim rehabilitation, possible victim-offender reconciliation, and restoration of harmony in the community. Diversion programs are expected to include various minor offenses, alcohol-related offenses, domestic assault cases, all property offenses, and juvenile offenses.
