THIS ARTICLE SUGGESTS TO CONSUMERS AND THEIR ADVOCATES A METHOD OF ATTACKING THE INTRUSIONS OF PRIVACY REPRESENTED BY DIRECT MAIL ADVERTISING AND CANVASS TELEPHONE SOLICITATION.
Abstract
BY ATTACKING THE INVASIONS OF PRIVACY AT THEIR SOURCE, THE SALE OF THE CONSUMER'S NAME TO THOSE WHO EITHER CONTEMPLATE THE ACTUAL SOLICITATION, OR WHO PLAN ON RESELLING OR LEASING SUCH LISTS, THE PROLIFERATION OF THE EXPLOITATION OF NAME LISTS, AS WELL AS THE ACCOMPANYING SOLICITATION, WOULD BE REDUCED. THE LEGAL ISSUES INVOLVED IN THIS PROPOSAL, RELEVANT COURT CASES, APPLICABLE LEGISLATION, AND PRACTICAL CONSIDERATIONS ARE DISCUSSED. THE AUTHOR CONCLUDES THAT THE BEST VEHICLE FOR REFORMS OF THE SALE OF NAME LISTS IS THE AMENDMENT OF THE FEDERAL FAIR CREDIT REPORTING ACT. (AUTHOR ABSTRACT MODIFIED)...MSP
