DISCUSSION OF THE DRAFT OF A PROGRESSIVE FEDERAL CODE OF CRIMINAL CORRECTIONS PROPOSED BY THE WEST GERMAN CRIMINAL CORRECTION COMMISSION.
Abstract
THE CODE PROPOSES THAT THE POSITION OF THE PRISONER SHOULD DIFFER FROM THAT OF THE FREE CITIZEN ONLY TO THE EXTENT NECESSARY TO ACCOMMODATE TWIN GOALS OF REHABILITATION AND RESOCIALIZATION. RECOGNIZING THAT DIFFERENCES IN INDIVIDUALS AND CRIMES DEMAND VARIED APPROACHES, THE CODE PROVIDES FOR SPECIAL TREATMENT OF ALCOHOLICS, ADDICTS, THE INSANE, AND VIOLENT OFFENDERS. INITIAL PERSONALITY INVESTIGATIONS FACILITATE PROPER PROGRAM AND LODGING ASSIGNMENT. SINCE THE CONCEPT OF THE PRISONER AS A WORKER WHO HAS BEEN DENIED HIS FREEDOM IS BASIC TO THE PROGRAM, INCOME WILL BE PROPORTIONATE TO PERFORMANCE, AND WORK CONDITIONS WILL APPROXIMATE THOSE ON THE OUTSIDE. PROVISIONS FOR ADULT EDUCATION, LEISURE AND SOCIAL COUNSELING, AND REGULAR VACATIONS ARE CRITICAL TO RESOCIALIZATION AND CONSEQUENTLY ARE EMPHASIZED.
