Ohio recently altered its criminal sentencing structure by increasing the penalties for certain specified violent, potentially violent and repeat offenders. Professor Guttenberg examines these statutory changes and many of the procedural and definitional questions left unanswered by this recent legislation.
Abstract
Professor Guttenberg concludes that the new sentencing statutes will generate considerable litigation before many of these questions are resolved and that the prosecution will ultimately obtain greater leverage in coaxing criminal defendants into pleading guilty.
