DISCUSSION OF THE RESULTS OF A NATIONAL TELEPHONE AND MAIL SURVEY OF 41 PROSECUTORS' OFFICES ON THEIR HANDLING OF RAPE CASES AND THEIR TREATMENT OF THE RAPE VICTIM.
Abstract
OFFICES WERE SURVEYED AS TO TYPE OF OFFICE (LARGE VERSUS SMALL), KIND OF LEGAL AND NONLEGAL PERSONNEL USED, PROCEDURAL COURTROOM MODIFICATIONS, SPECIAL TRAINING CONDUCTED FOR PERSONNEL, AND COORDINATION WITH COMMUNITY GROUPS, POLICE, AND MEDICAL FACILITIES DEALING WITH RAPE VICTIMS. SITE VISITS WERE MADE TO 18 OF THE PROSECUTORS' OFFICES SURVEYED WHICH SHOWED EVIDENCE OF HAVING INNOVATIVE PROGRAMS AND PROCEDURES FOR RESPONDING TO RAPE. BASED ON SURVEY RESULTS, GUIDELINES ARE SUGGESTED FOR THE MANAGEMENT OF RAPE CASES BY PROSECUTORS' OFFICES. RECOMMENDATIONS INCLUDE ESTABLISHING SEPARATE SEX CRIMES OR SEXUAL ASSAULT UNITS FOR THE PROSECUTION OF ALL RAPES, ASSIGNING RAPE CASES TO INDIVIDUAL PROSECUTORS ON A ONETO-ONE BASIS, AND USING NONLAWYER PERSONNEL AS INFORMATION COORDINATORS FOR RAPE VICTIMS, WITNESS SUPPORT PERSONS, AND TRANSLATORS FOR NON-ENGLISH SPEAKING VICTIMS.
