In R. v. Canadian Newspapers Co. Ltd., the right to insist on the non-publication of names and other identifying information was appealed, and the appeal was granted as a reasonable limit on freedom of the press.
Abstract
However, the appeal was not granted based on reasoning regarding the equal rights of women and children to freedom of expression, liberty, security of the person, and equality, but rather on the concept of public interest policy and gender nonspecific social control. The issue of "fairness" of such a nondisclosure policy is also reviewed. In conclusion, this particular case demonstrated the success of the first major constitutional challenge to the law of sexual assault even though it was made without consideration for the victim or the accused. 34 footnotes.
