ANALYSIS OF THE IMPLICATIONS OF THE SUPREME COURT RULING IN PAUL V DAVIS (1976) WHICH AFFIRMED THE SUPREMACY OF PUBLIC INTEREST IN SECURITY TO THE PRIVACY AND REPUTATION RIGHTS OF INDIVIDUALS IN DISSEMINATING ARREST RECORDS.
Abstract
THE AUTHOR EXAMINES FACTS OF THE CASE AND COURT OPINIONS AS WELL AS THE SCOPE OF THE DUE PROCESS CLAUSE WITH REGARD TO THE RIGHT TO REPUTATION. IT IS CONCLUDED THAT THE FAILURE OF THE COURT TO RECOGNIZE THE DUE PROCESS ARGUMENTS IN PAUL V DAVIS SERIOUSLY WEAKENS INDIVIDUAL RIGHTS WITH NO COUNTERVAILING PUBLIC BENEFIT.
