Abstract
THE TRADITIONAL FORMULATION OF THE INSANITY DEFENSE IS NO CLEARER THAN ITS MODERN MODIFICATIONS. A MORE RATIONAL APPROACH WOULD BE TO DECIDE GUILT OR INNOCENCE AND LET THE OFFENDER'S PSYCHIATRIC DIAGNOSIS DETERMINE HIS CUSTODY AND TREATMENT.
