THE LEGAL CATEGORIES OF DANGEROUSNESS NEED REASSESSING IN LIGHT OF MODERN FINDINGS OF PSYCHIATRY AND CRIMINOLOGY, ESPECIALLY CONCERNING ENVIRONMENTAL INFLUENCES.
Abstract
DANGEROUSNESS TO ONESELF OR OTHERS ARISING FROM MENTAL ILLNESS SHOULD BE ASSESSED ON THE BASIS OF THE TOTAL PERSONALITY AND ITS SOCIAL CONTEXT, NOT JUST ON THE EXISTENCE OF THE DISEASE. SOCIAL DANGEROUSNESS (TENDENCY OR LIKELIHOOD TO COMMIT CRIME) MAY OR MAY NOT RELATE TO MENTAL DEFECTS OR ILLNESS, BUT IT ALSO SHOULD BE ASSESSED THROUGH EXAMINATION OF THE SUBJECT AS A WHOLE, INCLUDING SOCIAL AND CULTURAL FACTORS. MENTAL HOSPITALS SHOULD NOT BE SEEN AS PLACES OF CONTINUING ISOLATION, BUT AS ONE LIMITED MEASURE IN THE RANGE OF PSYCHIATRIC ASSISTANCE. --IN ITALIAN
