THE RELATIONSHIPS OF PROSECUTORS WITH OTHER ELEMENTS IN THE CRIMINAL JUSTICE SYSTEM (POLICE, THE JUDICIARY, DEFENSE COUNSEL, THE COMMUNITY, AND THE PRESS) ARE ANALYZED. SUGGESTIONS FOR IMPROVEMENTS ARE MADE.
Abstract
THE SUCCESS OF ANY INDIVIDUAL ELEMENT IN THE CRIMINAL JUSTICE SYSTEM SHOULD BE MEASURED BY THE OVERALL EFFECT OF THE SYSTEM ON CRIME REDUCTION AND CITIZEN SATISFACTION WITH THE DELIVERY OF JUSTICE. STANDARD 12.9 OF THE NATIONAL ADVISORY COMMISSION ON CRIMINAL JUSTICE STANDARDS AND GOALS SETS THE RELATIONSHIP OF THE PROSECUTOR WITH THE POLICE DEPARTMENT, THE COURT AND DEFENSE COUNSEL, CORRECTIONAL AGENCIES, AND THE PUBLIC. A DETAILED ANALYSIS OF THE PROSECUTOR'S RELATIONSHIPS WITH THE POLICE, THE JUDICIARY, THE DEFENSE COUNSEL, THE VICTIM/WITNESS, THE COMMUNITY, AND THE PRESS IS PRESENTED. POINTS OF FRICTION WHICH MAY ARISE BECAUSE OF THE OVERLAPPING OF ROLES, PERCEIVED INDIFFERENCE, AND THE NATURAL ROLES OF ADVERSARIES ARE EXAMINED, AND SOME SOLUTIONS TO AVOID CONFLICT ARE OFFERED. STANDARDS GOVERNING EACH SET OF RELATIONSHIPS FORMULATED BY THE AMERICAN BAR ASSOCIATION FOR CRIMINAL JUSTICE, THE NATIONAL DISTRICT ATTORNEYS ASSOCIATION, AND THE MODEL DEPARTMENT OF JUSTICE ACT ARE LISTED AND COMMENTED UPON.
