THE HISTORICAL BSCKGROUND AND BASIC TENETS OF THIS PROPOSAL ARE OUTLINED, AND ITS REFORM EFFECTS ARE ECPLAINED. SUGGESTED LEGISLATION FOR IMPLEMENTING THE SCREENING PROPOSAL IS DETAILED.
Abstract
THE PRESELECTION SCREENING PROPOSED WOULD CONSIST OF TESTING DESIGNED TO ASSESS THE CANIDATES' COMPETENCE AND QUALIFICATIONS, ALONG WITH A SCREENING PANEL TO BE ESTABLISHED AND OPERATED ACCORDING TO RULES GOVERNING ITS COMPOSITION AND PROCEDURES. IT IS PREDICTED THAT THE ADOPTION OF MANDATORY PRESSELECTION SCREENING WOULD IMPROVE THE ELECTIVE SYSTEM WHILE KEEPING OPEN-ENDED THE CONTROVERSIAL QUESTION OF HOW SELECT FORM AMONG THOSE WHO PASS THE SCREENING. THE CONCEPT OF THE STATUTE, THE MANDATORY NATURE OF SCREENING, THE JUDICIAL SCREENING COMMITTEES, THE MAKEUP OF THE JUDICIAL SCREENING COMMITTEES, QUALITIES THE COMMITTEE SHOULD CONSIDER, PROCEDURES FOR THE COMMITTEE, STAFFING AND FUNDING, AND THE REMOVAL AND DISCIPLINE OF COMMITTEE MEMBERS ARE ALL AREAS CONSIDERED UNDER THE DISCUSSION OF A MODEL STATUTE TO IMPLEMENT THE PROPOSAL. FINALLY, CONSTITUTIONAL QUESTIONS ARE DISCUSSED....RCB
