HEARINGS ON FEDERAL RAPE SAFEGUARDS BILL DISCUSSES ADMISSABILITY OF EVIDENCE CONSIDERATIONS.
Abstract
WITNESSES AT THIS HEARING OFFERED PRO AND CON REMARKS ON PARTS OF THE PROPOSED LEGISLATION DEALING WITH THE DEGREE TO WHICH A RAPE VICTIM IS REQUIRED TO REVEAL HER PRIOR SEXUAL HISTORY. THIS HISTORY, ACCORDING TO THE BILL'S AUTHOR, IS PERSONAL AND SHOULD BE EXEMPT FROM THE PUBLIC EXPOSURE OF A TRIAL. WITNESSES OPPOSING THE PRIVACY PROVISONS FELT THAT A DEFENDANT'S TRIAL RIGHTS WOULD BE JEOPARDIZED UNLESS THE MEASURE WAS CHANGED. THE WITNESSES INCLUDED WOMEN'S RIGHTS ADVOCATES, DEPARTMENT OF JUSTICE OFFICIALS, AND LEGAL AUTHORITIES....BS
