Prison inmates' rights under the Canadian Charter of Rights and Freedoms were the subject of three recent Canadian lower court cases.
Abstract
Complainants argued that cell overcrowding, policies toward remand inmates held for inability to meet bail requirements, and denial of voting privileges were infringements of their Charter rights. Even though the courts considered the applicability of the Charter, cases were decided on the basis of technical distinctions and American jurisprudence and generally upheld correctional facility policies and conditions. The courts indicated that remand inmates might be treated differently from sentenced inmates, and sentenced inmates in custody might be treated differently from probationers.
