A CRITICAL ANALYSIS OF THE PROVISIONS OF THE TEMPORARY LEGISLATION ENACTED BY GREAT BRITAIN TO CONTROL TERRORIST ACTIVITIES INVOLVING NORTHERN IRELAND.
Abstract
THE AUTHOR DISCUSSES THE CONCERNS RAISED BY THE SPECIAL POWERS GIVEN TO LAW ENFORCEMENT OFFICERS AND THE JUDICIARY IN ARRESTING AND DETAINING PERSONS PRESUMED TO BE INVOLVED IN TERRORIST ACTIONS. ADMITTING THAT THE PROVISIONS ARE ONLY TEMPORARY, HE NEVERTHELESS POINTS OUT THAT THE DEFINITION OF TERRORISM IMPLICIT IN THE LEGISLATION GOES BEYOND THE EXISTING DEFINITION OF COMMON LAW CRIMES.
