THIS ARTICLE ANALYZES THE PRESENT AND FUTURE OF THE USE OF PROBATION, SUSPENDED SENTENCES, AND FINES FROM TWO DIFFERENT POINTS OF VIEW - THE FUNCTIONAL AND THE HISTORICAL.
Abstract
AN EXAMINATION OF THE USE AND SUCCESS OF THESE AND OTHER NON-INSTITUTIONAL TREATMENTS WORLDWIDE LEADS TO THE CONCLUSION THAT ITS LACK OF SUCCESS IS DUE TO TWO MISCONCEPTIONS - ONE CONCERNING THE AIM OF CRIMINAL JUSTICE AND THE OTHER CONCERNING ITS EXTENT. THE AUTHOR CONTENDS THAT, LOGICALLY, THE AIM OF CRIMINAL JUSTICE IS SIMPLY JUSTICE, NOT REHABILITATION, READAPTATION, AND CORRECTION. THE SECOND MISCONCEPTION IS TO THINK THAT CRIMINAL LAW MAY SOLVE PROBLEMS WHICH ACTUALLY SHOULD BE SOLVED IN OTHER AREAS OF POLICY MAKING.
