ADVICE ON ALL PHASES OF DEFENSE WORK IN POLITICAL CRIMINAL TRIALS, INCLUDING PREPARATION OF THE CASE, RELATIONSHIPS WITH TRIAL PERSONNEL, JURY SELECTION, OPENING STATEMENTS, CROSS-EXAMINING, AND FINAL ARGUMENTS.
Abstract
TWO KINDS OF POLITICAL TRIALS ARE CONSIDERED-THE ADMITTED CRIME INTENDED AS A POLITICAL PROTEST AND THE DISPUTED CRIME PROSECUTED FOR POLITICAL REASONS. GUIDANCE ON RELATING TO YOUNGER CLIENTS AND ADVICE TO BE GIVEN THEM ON THEIR APPEARANCE AND DEMEANOR IN THE COURTROOM IS OFFERRED. GENERAL RULES FOR BUILDING THE DEFENSE CASE AND PROCEDURES FOR FINDING AND DEALING WITH WITNESSES, PHOTOGRAPHS, AND PROSECUTION EVIDENCE IS DISCUSSED. ATTENTION IS GIVEN TO THE FACTORS AFFECTING THE CHOICE OF A JUDGE OR JURY. WHAT TO CONSIDER IN CROSS-EXAMINING VARIOUS TYPES OF PROSECUTION WITNESSES IS TREATED, ALONG WITH THE MECHANICS OF SCHEDULING DEFENSE WITNESSES. THE ORGANIZATION, FORM, AND A SAMPLE CONTENTS FOR THE FINAL ARGUMENT IS PRESENTED. THE APPENDIXES INCLUDE SAMPLE DISCOVERY MOTIONS TO BE OFFERRED AS THE TRIAL PROGRESSES, SAMPLE JURY INSTRUCTIONS, AND OTHER FORMS INVOLVED IN DEFENSE PREPARATION.
