THE PHILADELPHIA COURT BAIL PROGRAM IS DESIGNED TO AVOID UNNECESSARY INCARCERATION AND FEATURES CONTINUED CONTACT WITH DEFENDANTS BY STAFF.
Abstract
RELEASE ON RECOGNIZANCE AND THE TEN PERCENT CASH BAIL PROGRAM BEGINS WITH AN INTERVIEW PHASE, CONDUCTED BY A LAW STUDENT, DURING WHICH THE DEFENDANT'S ELIGIBILITY FOR PRE-TRIAL RELEASE AND NEED FOR COUNSEL ARE ASSESSED. ELIGIBILITY IS FIGURED BY A POINT SYSTEM BASED ON FOUR MAJOR CRITERIA - RESIDENCY, FAMILY TIES, EMPLOYMENT, PRIOR RECORD. DURING ARRAIGNMENT, THE JUDGE RULES THAT THE DEFENDANT BE ASSIGNED TO ROR OR TO 10 PERCENT CASH BAIL. SUBSEQUENT PHASES ARE HANDLED BY FOUR OTHER DEPARTMENTS. A NOTIFICATION DEPARTMENT INFORMS THE DEFENDANT OF COURT APPEARANCES. A VERIFICATION DEPARTMENT MAKES ADDITIONAL INVESTIGATION INTO A DEFENDANT'S BACKGROUND. A COURT REPRESENTATIVE DEPARTMENT PETITIONS AND APPEARS IN COURT FOR THOSE DEFENDANTS UNABLE TO APPEAR DUE TO SICKNESS. THE FINAL FOLLOW-UP IS PERFORMED BY AN INVESTIGATIVE DEPARTMENT THAT APPREHENDS THOSE FAILING TO APPEAR. FURTHER OPERATIONAL DETAILS AND STAFF PERSONNEL FUNCTIONS ARE DESCRIBED. PRELIMINARY EFFECTIVENESS STATISTICS ARE PROVIDED FOR BOTH PHASES OF THE PROGRAM.
