A FRAMEWORK WITHIN WHICH TO ANALYZE AND UNDERSTAND THE OBJECTIVES OF COURT PERSONNEL SYSTEMS AND RELATED ISSUES AND PRACTICAL PROBLEMS IS PRESENTED IN A MONOGRAPH BASED ON THE EXPERIENCE OF 60 TECHNICAL ASSISTANCE STUDIES.
Abstract
THE REPORT, PREPARED IN CONJUNCTION WITH THE AMERICAN UNIVERSITY LAW SCHOOL (WASHINGTON, D.C.) CRIMINAL COURTS TECHNICAL ASSISTANCE PROJECT, OPENS WITH AN OVERVIEW COVERING THE NEED FOR PERSONNEL MANAGEMENT IN THE COURTS AND BACKGROUND INFORMATION ON COURT PERSONNEL SYSTEMS. THE SCOPE AND NATURE OF COURT PERSONNEL MANAGEMENT, THE ALLOCATION OF MANAGEMENT RESPONSIBILITIES, LEGAL REQUIREMENTS AND COURT PERSONNEL, AND SPECIFIC AREAS OF CONCERN WITH REGARD TO PERSONNEL MANAGEMENT ARE DISCUSSED, AS ARE PATRONAGE, MERIT SYSTEMS, COLLECTIVE BARGAINING, AND PERSONNEL SYSTEM MODELS (STATE, LOCAL, AND MIXED). THE DISCUSSION THEN TURNS TO THE TOOLS AND PROCESSES OF PERSONNEL ADMINISTRATION IN SECTIONS ON CLASSIFICATION, RECRUITING, EXAMINATIONS, COMPENSATION AND BENEFITS, RETENTION AND PROMOTION, AND DISCIPLINE AND EMPLOYEES' RIGHTS. OTHER SECTIONS OFFER GUIDELINES RELATIVE TO THE PREPARATION OF PERSONNEL RULES AND DISCUSS DEVELOPMENTS IN COLLECTIVE BARGAINING.
