STATE JUDICIAL NOMINATING COMMISSIONS THAT ARE REQUIRED BY LAW TO BE BIPARTISAN ARE LESS LIKELY TO LET POLITICAL CONSIDERATIONS AFFECT THEIR NOMINATIONS THAN PARTISAN OR UNCONTROLLED COMMISSIONS.
Abstract
THIS ARTICLE EXAMINES THE POLITICAL MAKEUP OF JUDICIAL NOMINATING COMMISSIONS IN COLORADO, FLORIDA, IOWA, AND MARYLAND. COLORADO, THE ONLY STATE OF THESE FOUR THAT HAS BIPARTISAN COMMISSIONS ESTABLISHED BY LAW, INDICATED THAT POLITICAL CONSIDERATIONS WERE LESS OF A FACTOR IN THEIR DECISIONS THAN THE OTHER FOUR STATES.
