GUIDELINES FOR DESIGNING ORGANIZED CRIME CONTROL STRATEGIES ARE DEVELOPED ON THE BASIS OF AN ANALYSIS OF THE RELATIONSHIP BETWEEN ENFORCEMENT EFFORTS AND THE ILLEGAL GAMBLING MARKETPLACE IN NEW JERSEY.
Abstract
THE ANALYSIS POINTS TO THE NEED FOR CRIMINAL JUSTICE AGENCIES TO DETERMINE WHETHER A GIVEN ILLEGAL PRACTICE IS PERCEIVED BY THE COMMUNITY AS EXPLOITIVE MONOPOLIZATION OR AS MUTUALLY UTILITARIAN. A FIVE-PART ANALYTICAL PARADIGM FOR MAKING THIS DISTINCTION IS SUGGESTED: (1) IDENTIFY THE PARTIES TO THE PRACTICE (CONTROLLERS, SERVICE DELIVERERS, CLIENTELE); (2) IDENTIFY THE INTERESTS OF THE PARTIES (WHO RECEIVES WHAT ECONOMICALLY, SOCIALLY, POLITICALLY); (3) IDENTIFY THE METHODS USED TO PURSUE THESE INTERESTS (IMPLICIT OR EXPLICIT VIOLENCE, ECONOMIC OR POLITICAL EXTORTION), (4) IDENTIFY THE POTENTIAL POWER STATUS AND RESOURCES OF THE PARTIES; AND (5) IDENTIFY THE EFFECTS ON THE COMMUNITY (E.G., INCREASES IN PREDATORY CRIME, DECLINE IN THE ECONOMY,). IT IS SUGGESTED THAT ONLY WHEN OBJECTIVE EVIDENCE SHOWS THAT EXPLOITIVE MONOPOLIZATION EXISTS (I.E., MORE IS BEING EXTRACTED FROM THE COMMUNITY THAN IS BEING RETURNED) SHOULD THE STATE INTERVENE. DETAILS OF THE NEW JERSEY STUDY AND OF THE CONCEPTS REFLECTED IN THE SUGGESTED ANALYTICAL PARADIGM ARE PRESENTED, TOGETHER WITH A DISCUSSION OF PROBLEMS THAT HAVE INHIBITED THE DEVELOPMENT OF EFFECTIVE STRATEGIES FOR CONTROLLING ORGANIZED CRIME.
