THIRTEEN ARTICLES DRAFTED BY THE ORGANIZATION OF AMERICAN STATES (O.A.S.) IN FEBRUARY 1971 FOR THE PURPOSE OF PREVENTING AND PUNISHING ACTS OF TERRORISM ARE PRESENTED.
Abstract
IT IS ADVISABLE TO ADOPT GENERAL STANDARDS THAT WILL PROGRESSIVELY DEVELOP INTERNATIONAL LAW AND COOPERATION IN THE PREVENTION AND PUNISHMENT OF TERRORISM. THEREFORE, TERMS TO FURTHER THIS GOAL ARE AGREED UPON BY MEMBER STATES. CONTRACTING STATES WILL COOPERATE BY TAKING ALL MEASURES CONSIDERED NECESSARY TO PREVENT AND PUNISH ACTS OF TERRORISM, ESPECIALLY KIDNAPPING, MURDER, AND OTHER ASSAULTS AGAINST LIFE OR PROPERTY. PERSONS CHARGED OR CONVICTED FOR ANY SUCH ACTS WILL BE SUBJECT TO EXTRADITION. THE STATE UNDER WHOSE JURISDICTION SUCH PERSONS ARE LOCATED MUST DETERMINE THE NATURE OF THE ACTS AND DECIDE WHETHER THE STANDARDS OF THIS CONVENTION ARE APPLICABLE. ANY PERSON DEPRIVED OF FREEDOM THROUGH APPLICATION OF THIS CONVENTION WILL BE GUARANTEED DUE PROCESS, AND WILL HAVE THE RIGHT OF ASYLUM. CONTRACTING STATES AGREE TO EXCHANGE INFORMATION, GUARANTEE PERSONS DEPRIVED OF FREEDOM THE RIGHT TO DEFEND THEMSELVES, COMPLY WITH EXTRADITION REQUESTS PROMPTLY, AND ENDEAVOR TO HAVE THE CRIMINAL ACTS LAWS. THIS CONVENTION IS OPEN FOR SIGNATURE BY MEMBER STATES AND OTHER MEMBERS OF THE UNITED NATIONS AND IS TO BE RATIFIED IN ACCORDANCE WITH EACH STATE'S CONSTITUTIONAL PROCEDURES. THE CONVENTION WILL REMAIN IN FORCE INDEFINITELY, BUT ANY OF THE CONTRACTING STATES MAY DENOUNCE IT BY NOTIFYING THE GENERAL SECRETARIAT OF THE ORGANIZATION OF AMERICAN STATES.
