AN ANALYSIS OF THE IMPORTANCE OF THE OFFENDER'S CRIMINALITY AND OF HIS PERSONAL CHARACTERISTICS IN JUVENILE COURT DECISION-MAKING.
Abstract
JUVENILE OFFICERS OF THE SAN DIEGO POLICE DEPARTMENT ALONG WITH PROBATION OFFICERS AND JUVENILE JUDGES OF SAN DIEGO COUNTY WERE ASKED TO RANK THE IMPORTANCE OF SEVERAL FACTORS IN THE PRESENTENCE REPORT IN MAKING DISPOSITIONAL DECISIONS. FROM THE RESULTS, PERSONAL FACTORS SEEMED TO HAVE GREATER WEIGHT WITH THE COURT THAN WITH POLICE OR PROBATION PERSONNEL. THE POLICE AND PROBATION OFFICERS FELT THE SERIOUSNESS OF THE PRESENT OFFENSE TO BE OF PRIMARY IMPORTANCE. THIS STUDY INDICATES THAT THE NATURE OF THE OFFENSE HAS LESS IMPACT ON THE DISPOSITION OF THE CASE BEFORE THE COURT THAN AT OTHER LEVELS IN THE JUVENILE JUSTICE SYSTEM. AUTHOR MODIFIED
