NORTH CAROLINA'S PLAN FOR ASSURING COMPLIANCE WITH STATE AND FEDERAL LAWS AND REGULATIONS GOVERNING THE SECURITY AND PRIVACY OF CRIMINAL JUSTICE INFORMATION IS PRESENTED.
Abstract
IN ADDITION TO THE CONFIDENTIALITY OF CRIMINAL HISTORY INFORMATION, THE PLAN IS CONCERNED WITH PRESERVING NORTH CAROLINA'S TRADITION OF FREE AND READY PUBLIC ACCESS TO PUBLIC INFORMATION MAINTAINED BY STATE AND LOCAL GOVERNMENTS. THE SCOPE OF THE PLAN ENCOMPASSES ALL CRIMINAL JUSTICE INFORMATION MAINTAINED BY NORTH CAROLINA STATE AND LOCAL CRIMINAL JUSTICE AGENCIES, CRIMINAL JUSTICE INFORMATION SUBJECT TO THE SECURITY AND PRIVACY PLAN REQUIRED BY THE LAW ENFORCEMENT ASSISTANCE ADMINISTRATION, AND CRIMINAL JUSTICE INFORMATION REPORTED TO THE COMPUTERIZED CRIMINAL HISTORY CENTRAL STATE REPOSITORY. THE STATE'S POSITION ON KEY ELEMENTS OF FEDERAL SECURITY AND PRIVACY REGULATIONS IS SUMMARIZED. OBJECTIVES AND STRATEGIES ARE SET FORTH RELATIVE TO RIGHT OF PRIVACY, DATA COLLECTION, VERIFICATION OF IDENTITY, INDIVIDUAL ACCESS OR REVIEW, PHYSICAL SECURITY OF CENTRAL DATA REPOSITORIES, PERSONNEL SECURITY, COMPUTERIZED SYSTEM SECURITY, DISSEMINATION, AND OTHER ASPECTS OF DATA CONFIDENTIALITY. THE RESPONSIBILITIES OF SPECIFIC AGENCIES ARE DELINEATED. MILESTONES IN THE DEVELOPMENT OF NORTH CAROLINA'S PRIVACY AND SECURITY PLAN ARE CITED. RELEVANT FEDERAL RULES AND REGULATIONS AND STATE RESOLUTIONS ARE APPENDED.
