DEVELOPMENT OF THE LAW ON FETAL RIGHTS, CONSTITUTIONAL QUESTIONS INVOLVED IN ATTACKS ON RESTRICTIVE ABORTION STATUTES, AND ISSUES LEFT OPEN IN THE REFORM LEGISLATION.
Abstract
PRECEDENTS FROM THE TORT LAW OF PRENATAL INJURY AND INFANT DAMAGE SUITS ARE ANALYZED TO DETERMINE IF THE LEGAL DEFINITION OF A PERSON INCLUDES A FETUS AT ANY STAGE OF GESTATION. THERE IS A SUMMARY OF RECENT DECISIONS ON THE RIGHT TO PRIVACY AS IT RELATES TO A WOMAN'S DECISION ON ABORTION. STATISTICS ARE PROVIDED ON THE OPERATION OF THE REFORM LAW IN NEW YORK CITY. SEVERAL ISSUES WHICH WERE NOT DETERMINED IN THE REFORM BILL, SUCH AS THE RIGHTS OF THE HUSBAND - FATHER AND RESIDENCY REQUIREMENTS, ARE DISCUSSED AND RELATED TO EXISTING CASE LAW.
