This digest summarizes the dispositions of 69 New York State cases in which convictions were obtained for criminal violations of environmental laws for the period 1987-1989.
Abstract
The 69 cases presented involved offenses related to waste abandonment; air; asbestos; the falsification of business records; violations of the Comprehensive Environmental Response and Liability Act; endangerment of public health, safety, or environment; infectious waste (disposal, transferring, and transportation); hazardous waste (storage, transportation, unlawful dealing, unlawful disposal, and unlawful possession); noisome or unwholesome substances (construction debris and disposal); violations of the Resource Conservation Recovery Act; reporting of spills of liquids stored in bulk waste, oil, and gas; and water. A chart compares sentences in environmental cases for the periods 1986-87 and 1988-89. They include criminal fines (corporate and individual), incarceration (cumulative), restitution (cumulative), environmental audits required as a condition of sentence, and financial contributions to local emergency planning committees.
