FACT SHEET AND CRITIQUES OF CONTROVERSIAL AND NON-CONTROVERSIAL ITEMS OF STATE HOUSE BILL 511 AS STUDIED BY THE LEAGUE OF WOMEN VOTERS OF METROPOLITAN COLUMBUS (OH).
Abstract
THE CONTROVERSIAL ITEMS DISCUSSED INCLUDE THE DEFINITIONS OF AND PENALTIES FOR THE FOLLOWING OFFENSES: INCITING TO VIOLENCE, FAILURE TO DISPERSE, FALSIFICATION, FAILURE TO AID A LAW ENFORCEMENT OFFICER, RESISTING ARREST, ESCAPE, CONSPIRACY, AND ATTEMPT TO COMMIT AN OFFENSE. OTHER OFFENSES STUDIED INCLUDE ARREST BY LAW ENFORCEMENT OFFICER ON VIEW OR REASONABLE CAUSE, THEFT, ROBBERY, VOLUNTARY AND INVOLUNTARY MANSLAUGHTER, NEGLIGENT HOMICIDE, AGGRAVATED VEHICULAR HOMICIDE, VEHICULAR HOMICIDE, ASSAULT, AND NEGLIGENT ASSAULT. THE AUTHOR POINTS OUT THAT THE MAJORITY OF THESE OFFENSES ARE EITHER NEW OFFENSES UNDER OHIO LAW OR CONSTITUTE AN UPGRADING OF THE OFFENSES IN EXISTENCE PRIOR TO THE LAW CODE.
