AN OVERVIEW OF REFORM EFFORTS IN THE AREAS OF JUVENILE COURT PROCEEDINGS, JUVENILE CORRECTIONAL PROGRAMS, AND DEINSTITUTIONALIZATION OF STATUS OFFENDERS IS PRESENTED, WITH SPECIAL REFERENCE TO DEVELOPMENTS IN OHIO.
Abstract
THE DISCUSSION OPENS WITH A NATIONAL PERSPECTIVE ON COURT DECISIONS AND CAMPAIGNS BY NATIONAL ORGANIZATIONS AND CHILD ADVOCACY GROUPS IN THE AREAS OF DUE PROCESS RIGHTS FOR YOUTHS IN JUVENILE COURT PROCEEDINGS, RIGHTS AND POLICIES THAT SHOULD APPLY TO JUVENILES IN DETENTION AND CORRECTIONAL FACILITIES, AND THE REMOVAL OF JUVENILE NONOFFENDERS FROM TRAINING SCHOOLS AND DETENTION CENTERS. THE EFFORTS OF THE OHIO JUVENILE JUSTICE TASK FORCE TO ADDRESS THE ISSUES RAISED AT THE NATIONAL LEVEL ARE REVIEWED, INCLUDING THE TASK FORCE'S RECOMMENDATIONS THAT FULL DUE PROCESS RIGHTS BE ACCORDED JUVENILES, THAT OHIO SHIFT THE EMPHASIS OF ITS JUVENILE CORRECTIONS SYSTEM TOWARD COMMUNITY-BASED PROGRAMS, AND THAT THE JUVENILE COURT'S STATUS OFFENSE JURISDICTION BE RESTRICTED AND MORE CLEARLY DEFINED. A SUMMARY IS PRESENTED OF STATE-LEVEL RESPONSE TO DUE PROCESS, CORRECTIONS/TREATMENT, AND STATUS OFFENSE ISSUES, WITH REFERENCE TO AMENDED OR TOTALLY REVISED JUVENILE CODES ENACTED BY MANY STATE LEGISLATURES. IT IS POINTED OUT THAT THE MOST SIGNIFICANT STATE-LEVEL ACTIVITY HAS BEEN THAT CONCERNED WITH THE HANDLING OF STATUS OFFENDERS. MAINE'S VIRTUAL ELIMINATION OF COURT JURISDICTION OVER STATUS OFFENSES IS NOTED, AS ARE LEGISLATIVE REFORMS IN UTAH, VIRGINIA, AND WASHINGTON WHICH HAVE REVISED SUBSTANTIALLY PROCEDURES FOR HANDLING STATUS OFFENDERS. FEDERAL DISCRETIONARY GRANT PROGRAMS TO ENCOURAGE DEINSTITUTIONALIZATION OF JUVENILES, USE OF ALTERNATIVES TO INCARCERATION, AND PROTECTION OF THE RIGHTS OF JUVENILES ARE ALSO NOTED. (LKM)
