The second part of a series of reports on arrangements for mutual judicial assistance among the East European COMECOM countries deals with mutual agreements in criminal cases.

Abstract

In the narrowest sense, mutual judicial assistance in penal cases covers the service of documents, transmission of evidence, and the performance of specific steps in legal proceedings. A convention between the COMECOM countries signed on 19 May 1978 provides for convicted persons to be handed over for execution of imprisonment sentences in the country of citizenship. The extradition provisions in the mutual judicial assistance agreements are almost identical to those of classical extradition agreements, with the major exception that political crimes are grounds for extradition by the COMECOM states.
