CODIFICATION OF PERMISSIBLE BOUNDARIES OF ACCEPTABLE INMATE BEHAVIOR AND GUIDELINES FOR STAFF PROCEDURES.
Abstract
THE MASSACHUSETTS DEPARTMENT OF CORRECTIONS REQUESTED THAT THE CENTER FOR CRIMINAL JUSTICE OF THE BOSTON UNIVERSITY SCHOOL OF LAW PREPARE THESE MODEL RULES AND REGULATIONS. THE RULES INCORPORATE RECENT COURT DECISIONS AS WELL AS MODERN CORRECTIONAL THINKING. THEY COVER SUCH TOPICS AS DISCIPLINARY AND GRIEVANCE PROCEDURES, INSTITUTIONAL STANDARDS, PROCEDURES FOR MAIL INSPECTION, AND VISITATION RULES. ALSO DELINEATED ARE THE RIGHTS AND RESPONSIBILITIES OF INMATES IN REGARD TO CONSTITUTIONAL ISSUES SUCH AS FREE SPEECH, ASSOCIATION, AND RELIGIOUS PRACTICES. THESE AREAS ARE DIVIDED INTO SECTIONS AND EACH SECTION FURTHER DIVIDED INTO COMPONENT RULES. EACH RULE IS STATED AND FOLLOWED BY A COMMENTARY WHICH AMPLIFIES THE SCOPE OF THE RULE, MAKES ITS INTENDED PURPOSE EXPLICIT, AND REFERS TO THE RELEVANT CASE LAW ON THE SUBJECT. FOR MANY OF THE RULES, AN INTRODUCTORY NOTE PROVIDES BACKGROUND MATERIAL SHOWING THE NEED FOR CODIFICATION. (SNI ABSTRACT)
