THIS MODEL PROCUREMENT CODE FOR SUPPLIES, SERVICES, AND CONSTRUCTION FOR PUBLIC PURPOSES, WAS PREPARED BY THE AMERICAN BAR ASSOCIATION AND IS DESIGNED FOR USE BY STATE AND LOCAL GOVERNMENTS.
Abstract
THE CODE HAS THREE MAIN PARTS. FIRST ARE STATUTORY PRINCIPLES AND POLICY GUIDANCE FOR PROCUREMENT MANAGEMENT AND CONTROL. SECOND THE ADMINISTRATIVE AND JUDICIAL REMEDIES FOR RESOLUTION OF CONTROVERSIES RELATING TO PUBLIC CONTRACTS. THIRD IS A SET OF ETHICAL STANDARDS THAT SHOULD GOVERN BOTH PUBLIC OFFICIALS AND PRIVATE CONTRACTORS IN THE PROCUREMENT PROCESS. BECAUSE OF VARIATIONS IN STATE AND LOCAL GOVERNMENT STRUCTURES, THE CODE IS DESIGNED AS A MODEL CODE RATHER THAN A UNIFORM CODE. JURISDICTIONS SHOULD ADAPT THE PROPOSED CODE TO THEIR OWN SITUATIONS. IN SUBSTANTIVE MATTERS, HOWEVER, THE BASIC PRINCIPLES ARE APPLICABLE TO ALL PUBLIC BODIES. IN SOME OF THE 12 ARTICLES OF THE CODE, ALTERNATIVES INDICATING MORE THAN 1 POSSIBLE APPROACH TO A GIVEN PROCUREMENT POLICY ARE INCLUDED. COMMENTARY IS ADDED TO EXPLAIN THE RATIONALE FOR THE PROVISIONS, TO INTERPRET THE LANGUAGE, OR TO PROVIDE GUIDANCE OR THE DEVELOPMENT OF OR IMPLEMENTATION OF REGULATIONS. BRACKETS ARE USED TO INDICATE AREAS NEEDING PARTICULAR ATTENTION. DEFINITIONS AND DEFINITIONAL CROSSREFERENCES ARE ALSO PROVIDED. THE THE APPENDIX LISTS COMMITTEES, INDIVIDUALS, AND PILOT JURISDICTIONS MOST INVOLVED IN DEVELOPING THE CODE. (CFW)
