DISCUSSION OF THE MODEL PENAL CODE AS PUT FORTH BY THE AMERICAN LAW INSTITUTE.
Abstract
THE PRESENTATION OF THE CODE SHOULD INVITE A SYSTEMATIC REEXAMINATION OF ATTITUDES AND PRACTICES IN THE CRIMINAL JUSTICE SYSTEM. THE EFFORTS OF THE AMERICAN LAW INSTITUTE IN FORMULATING THE CODE IS BRIEFLY DISCUSSED. THE CODE IS OUTLINED INTO FOUR SECTIONS. THE FIRST DEALS WITH GENERAL DEFINITIONS, PRINCIPLES, CRITERIA, AND CONDUCT. THE SECOND DEALS WITH DEFINITION OF SPECIFIC CRIMES. THE THIRD DEALS WITH SANCTIONS EMPLOYED IN SENTENCING, AND THE FOURTH DEALS WITH ORGANIZATION OF CORRECTIONAL SERVICES. THE APPLICATION OF THE CODE TO THE QUESTION OF CULPABILITY AS RELATED TO STRICT LIABILITY, FELONYMURDER, AND INTOXICATION IS PRESENTED IN GREATER DETAIL. THE OBJECTIVES OF SENTENCING AND OF CORRECTIONS UNDER THE CODE ARE PRESENTED. 40 REFERENCES
