MATERIALS USED IN TRAINING PERSONS IN THE USE OF MINNESOTA SENTENCING GUIDELINES ARE PROVIDED.
Abstract
THE PURPOSE OF THE SENTENCING GUIDELINES IS INDICATED TO BE THE ESTABLISHMENT OF RATIONAL AND CONSISTENT SENTENCEING STANDARDS WHICH WILL REDUCE SENTENCING DISPARITY AND INSURE THAT SANCTIONS FOR A FELONY CONVICTION ARE PROPORTIONAL TO THE SEVERITY OF THE OFFENSE AND THE EXTENT OF THE OFFENDER'S CRIMINAL HISTORY. PRINCIPLES EMBODIED IN THE SENTENCING GUIDELINES ARE NEUTRALITY RESPECTING THE DEMOGRAPHIC CHARACTERISTICS OF THE OFFENDER, CORRELATION BETWEEN THE SEVERITY OF SENTENCE AND THE SEVERITY OF THE OFFENSE AND THE OFFENDER'S CRIMINAL HISTORY, THE USE OF THE LEAST RESTRICTIVE SANCTION NECESSARY TO ACHIEVE THE PURPOSES OF THE SENTENCE, AND DEPARTURE FROM THE SENTENCING GUIDELINES ONLY WHEN SUBSTANTIAL AND COMPELLING CIRCUMSTANCES EXIST. INSTRUCTIONS ARE PROVIDED FOR DETERMINING PRESUMPTIVE SENTENCES USING THE SENTENCING GUIDELINES GRID PROVIDED, AND POLICIES ARE DESCRIBED FOR ESTABLISHING CONDITIONS OF STAYED SENTENCES, REVOKING STAYED SENTENCES, THE ASSIGNMENT OF JAIL CREDIT, SENTENCING CERTIFIED JUVENILES, AND THE USE OF PRESENTENCE MENTAL AND PHYSICAL EXAMINATIONS FOR SEX OFFENDERS. MATERIALS FOR USE IN DETERMINING SENTENCES IN HYPOTHETICAL CASES ARE PROVIDED FOR TRAINING. ALSO INCLUDED ARE THE OFFENSE SEVERITY REFERENCE TABLE, A SENTENCING WORKSHEET, A REVOCATION REPORT, A DEPARTURE REPORT, AND THE MINNESOTA SUPREME COURT ORDER REGARDING SENTENCING APPEALS.
