This article discusses two major concerns regarding the adverse effects of increased litigation in child protection cases: the fallout from the adversarial process on agencies' work with families; and the dissonance between the approaches of social workers and lawyers to decision making about families.
Abstract
Mediation is recommended to divert less serious cases from court proceedings. It is shown to be congruent with some existing agency procedures, and guidelines are presented for its implementation in the child welfare system. (Author abstract)
