EXPLANATION OF LEGISLATION PENDING BEFORE THE SENATE CALLING FOR THE IMPOSITION OF MANDATORY MINIMUM SENTENCES FOR CERTAIN TYPES OF VIOLENT STREET CRIMES (S. 2698) AND FOR THE ESTABLHSIMENT OF SENTENCING GUIDELINES (S. 2699).
Abstract
THE LEGISLATION IS BASED ON THE IDEA THAT THE PRIMARY FUNCTIONS OF IMPRISONMENT ARE DETERRENCE AND RETRIBUTION NOT FORCED REHABILITATION. THE STATUTES ARE INTENDED TO PUT AN END TO ARBITRARILY IMPOSED AND INDISCRIMINATE SENTENCING.
