AN EXAMINATION OF THE EXISTING MEANS BY WHICH THE DEFENSE COUNSEL, THE PROSECUTOR, AND THE JUDGE MAY ABUSE THE COURT APPOINTED ATTORNEY SYSTEM.
Abstract
THE SPECIFIC FORMS OF ABUSE DISCUSSED BY THE AUTHOR INCLUDE DEFENSE COUNSEL MISUSE OR OVERUSE OF THE FEE SYSTEM, JUDICIAL BIAS IN APPOINTING CERTAIN TYPES OF LAWYERS (THOSE LESS LIKELY TO CAUSE ADDITIONAL WORK BY BRINGING A CASE TO TRIAL), AND JUDICAL APPOINTMENT OF INCOMPETENT ATTORNEYS WHO MAY BE PAID EXTREMELY LOW RATES. THE AUTHOR SUGGESTS CREATION OF A PUBLIC DEFENDERS' OFFICE OR A BLIND DRAW SYSTEM OF COMPETENT ATTORNEYS TO AVOID THESE ABUSES.
