This article describes the juvenile justice system in Spain.
Abstract
The present law on juvenile justice follows the former legislation and is in accordance with the laws in the European countries and the Convention of the United Nations for the Children’s Rights. The principle of the best interest of the child is viewed as a perspective of interpretation of children’s rights. The law also provides an alternative to the judicial procedure, judicial measures different from imprisonment, and the accountability of the minor instead of punishment. The use of imprisonment is viewed as the only possible measure for terrorism crimes. The question is whether the importance is on children’s protection or society’s protection. 16 footnotes, 21 references
