This unit of instruction, used by the California Peace Officer Standards and Training (POST) system, provides guidelines on the development of appropriate lesson plans for performance objective-based law enforcement basic training. The learning goal of this unit is to give the student a working knowledge of the laws of arrest in California.
Abstract
According to audio-visual presentations based on the penal and vehicle codes, students will learn to identify situations in which the officer has the authority to arrest and the elements of an arrest. The students learn the amount of force that may be used in effecting an arrest and what information must be provided to the arrestee. Other performance objectives to be accomplished are knowing what the peace officer is required to do with the arrestee, the legal requirements of an entry, the requirements of a private citizen's arrest, and the extent of a peace officer's liability for false arrest. Finally, the students learn the exceptions which prevent arrests including diplomatic immunity, stale misdemeanor, and Congressional exceptions. 2 appendixes and 7 references
