Intended as a reference for attorneys, judges, and law enforcement and corrections officials, this book explains North Carolina legislative changes in the areas of sentencing, probation, and parole through the end of the 1996 General Assembly sessions, as well as relevant decisions of the North Carolina Supreme Court and Court of Appeals through March 1996.
Abstract
A chapter on authorized types of sentences focuses on the authority to punish, quasi-sentences, fines and costs, probation, and active prison or jail terms. A chapter on sentencing procedure covers plea bargaining, sentencing information, a recent history of sentencing law in North Carolina, the structured sentencing law, and the enhancement of felony sentencing for firearms use under the Structured Sentencing Law (SSL) and the Fair Sentencing Act (FSA). Other topics in this chapter are the Habitual Felon Law and the Violent Habitual Felon Law, the Drug Trafficking Law, and the Fair Sentencing Act. Aggravating and mitigating factors under the SSL and FSA are also discussed, along with sentencing for impaired driving. Other chapters address laws and court decisions that bear upon the modification and correction of sentences; the service of prison and jail sentences; the administration of probation, parole, and supervised release; and other post-conviction matters. 11 tables and a subject index
