Activities and proceedings of the Law Reform Commission of Western Australia are presented for the fiscal year July 1, 1980, to June 30, 1981.
Abstract
The structure, membership, chairmanship, and staff of the Commission are described, followed by descriptions of reports submitted and working papers issued, with particular attention to Commission recommendations. The reports deal with admissibility in evidence of computer records and other documentary statements, unclaimed money, liability of highway authorities for nonfeasance, and liability for stock straying onto the highway. Working papers deal with liability for stock straying onto the highway, Absconding Debtors Act, recognition of interstate and foreign grants of probate and letters of administration, and judicial review of administrative decision. Throughout the year, the Commission has worked with the Australian Law Reform Commission on various privacy issues for the purpose of formulating proposals for reform suitable for uniform adoption throughout Australia. Also discussed are the processing of law reform proposals; conferences, meetings, and seminars held by the Commission; cooperative law reform; and new referrals for Commission study from the Attorney General. Outlined are the projects under active consideration by the Commission as of June 30, 1981, along with the progress made on each project prior to that date. On June 30, 1981, the Commission's program consisted of 28 projects dealing with a wide range of matters, including amendments to the Local Courts Act and Rules, review of administrative decisions, the admissibility of reproductions, trusts and administration of estates, and unrepresented defendants in courts of petty sessions. Included in the appendixes are information on legislative action taken on Commission reports and a statement of the Commission's receipts and payments.
