Abstract
THE ROLE OF CRIMINAL LAW IN SOCIAL ORDER IS FIRST INVESTIGATED BY IDENTIFYING THE FUNDAMENTAL CONCEPTS GUIDING CHANGE IN LAW. A COMPARATIVE STUDY OF CRIMINAL LAW AND THE ORIGINS AND PREMISES OF ANGLO-AMERICAN CRIMINAL LAW ARE ALSO PRESENTED. ELEMENTS OF CRIMINAL LIABILITY, AND OFFENSES AGAINST PERSON, PROPERTY, HABITATION AND OCCUPANCY ARE DISCUSSED. DEFENSES TO CHARGES OF CRIMINAL LIABILITY ARE EXAMINED, AND RIGHTS OF THE VICTIM, THE INMATE, AND THE JUVENILE OFFENDER ARE CONSIDERED AS WELL. THE POSITIVE LAW, NATURAL RIGHTS, AND SOCIAL GOOD THEORIES OF JUSTICE ARE EXAMINED TO PROVIDE A BROAD VIEW OF JURISPRUDENCE. ADMINISTRATIVE LAW FOR THE CRIMINAL JUSTICE ADMINISTRATOR AND THE USE OF DISCRETION ARE STUDIED AS WELL. THE APPENDIX PROVIDES A STUDY OF THE METHOD BY WHICH LAW EVOLVES, IS RESEARCHED, AND BECOMES PRECEDENT FOR FUTURE LEGAL DECISIONS. A GLOSSARY, CASE INDEX, AND SUBJECT INDEX ARE INCLUDED.
