A 1978 UPDATE OF KENTUCKY'S PLAN FOR PRESERVING THE PRIVACY AND SECURITY OF CRIMINAL RECORD INFORMATION IS PRESENTED.
Abstract
THE BASIC GOAL OF THE PLAN IS TO ASSURE THAT CRIMINAL RECORD INFORMATION IS COLLECTED, STORED, AND DISSEMINATED IN A MANNER THAT ASSURES THE COMPLETENESS, INTEGRITY, ACCURACY, AND SECURITY OF INFORMATION AND THAT PROTECTS INDIVIDUAL PRIVACY. SEVERAL HISTORICAL EVENTS HAVE OCCURRED SINCE THE ORIGINAL PLAN WAS DEVELOPED IN 1976 THAT MAKE REVISION NECESSARY. PROPOSED ADMINISTRTIVE CHANGES RELATE TO THE FOLLOWING: (1) CENTRAL STATE REPOSITORY UPDATE (MAINTAIN FILES IN A SECURE MANNER, SUBMIT COPIES OF UNIFORM CITATION FOR ALL FELONIES AND FINGERPRINT CARDS PREPARED AT THE TIME OF ARREST, PARTICIPATE IN PERIODIC INFORMATION AUDITS, PROVIDE ALL INFORMATION REQUESTED ON POLICE FINGERPRINT IDENTIFICATION CARD WITHIN 10 DAYS OF THE ARREST, AND COOPERATE IN PERIODIC TRAINING PROGRAMS TO IMPROVE THE QUALITY AND TIMELINESS OF INFORMATION SUBMITTED TO THE CENTRAL REPOSITORY); (2) PERSONNEL SECURITY (SECURE NONDISCLOSURE AGREEMENTS FROM EMPLOYEES, DEVELOP AND PUBLISH PROCEDURES FOR THE DISSEMINATION OF INFORMATION TO NONCRIMINAL JUSTICE AGENCIES, CONDUCT INVESTIGATIONS OF ALL EMPLOYEES ASSOCIATED WITH THE CENTRAL REPOSITORY, AND INSTRUCT PERSONNEL IN PROCEDURES FOR HANDLING INFORMATION); (3) DISSEMINATION OF INFORMATION (RESTRICTIONS); AND (4) ADMINISTRATIVE APPEALS PROCESS FOR THE CORRECTION OF ERRONEOUS INFORMATION (PROCEDURES FOR INITIATING AN APPEAL, AGENCY RESPONSIBILITIES IN THE APPEAL PROCESS, AND APPEAL RESOLUTION). OBJECTIVES OF THE PLAN ARE ENUMERATED. THE IMPLEMENTATION PLAN AND SCHEDULE AND RELATED FORMS AND PROCEDURAL GUIDELINES FOR THE ADMINISTRATIVE REVISIONS ARE INCLUDED. (DEP)
