This 2008 Kansas Sentencing Commission Desk Reference Manual provides general instructions for applying the provisions of the Kansas Sentencing Guidelines Act (KSGA).
Abstract
Changes that affect the KSGA were made by the Kansas Legislature during its 2008 legislative session. These changes are summarized in the manual under the headings of the bills that contain the changes. The basics of the sentencing guidelines are outlined in one chapter, followed by a chapter on the implications of the sentencing guidelines for procedures prior to sentencing performed by law enforcement agencies, municipal courts, county/district courts, and juvenile courts. Procedures for determining crime severity levels and documenting criminal history are addressed in two other chapters. Another chapter presents the requirements for presentence investigation reports. A chapter on sentencing explains the sentencing range and options, followed by explanations of the application of the sentencing guidelines to various types of offenses and offenders. Remaining chapters explain appellate review principles, community sanctions and postrelease supervision, and retroactivity. Appendixes contain selected Kansas case law decisions on topics related to the KSGA and sentencing issues since 1993, selected Attorney General opinions on topics related to the KSGA and sentencing issues since 1993, approved and disapproved nonstatutory departure reasons cited by sentencing courts, KSGA forms and instructions, listings of felony and misdemeanor crimes, and sentencing ranges for drug and nondrug offenses.
