PART OF A SERIES DESIGNED TO COVER THE SPECTRUM OF PROBLEMS PERTAINING TO THE LAWS AFFECTING CHILDREN, THIS VOLUME CONTAINS STANDARDS AND COMMENTARY ON THE TRANSFER OF JUVENILES FROM JUVENILE COURTS TO CRIMINAL COURTS.
Abstract
THIS SERIES WAS PREPARED UNDER THE SUPERVISION OF A JOINT COMMISSION ON JUVENILE JUSTICE STANDARDS APPOINTED BY THE INSTITUTE OF JUDICIAL ADMINISTRATION AND THE AMERICAN BAR ASSOCIATION. THE STANDARDS ARE INTENDED TO SERVE AS GUIDELINES FOR ACTION BY LEGISLATORS, JUDGES ADMINISTRATORS, PUBLIC AND PRIVATE AGENCIES, LOCAL CIVIC GROUPS, AND OTHERS CONCERNED WITH THE TREATMENT OF YOUTHS. THIS VOLUME IS CONCERNED WITH WAIVER, THE PROCESS BY WHICH THE JUVENILE COURT RELEASES CERTAIN JUVENILES FROM ITS JURISDICTION AND TRANSFERS THEM TO THE CRIMINAL COURTS. THE STANDARDS IN THIS VOLUME EXPRESS A PREFERENCE FOR RETENTION BY THE JUVENILE COURT OF JURISDICTION OVER MOST PERSONS UNDER EIGHTEEN. HOWEVER, THEY DO PROVIDE SPECIFIC GUIDES FOR MAKING TRANSFER DECISIONS WHEN NECESSARY. THEY DISCUSS WHO DECIDES, UNDER WOSE INITIATIVES THESE DECISIONS ARE MADE, WHAT PROCEDURES AND INFORMATION ARE INVOLVED, AGE RANGE, AND THE NATURE OF THE DECISIONMAKING MECHANISMS.
