A REVIEW OF THE CURRENT DEBATE ON THE VALUE OF PUNISHMENT VERSUS REHABILITATION IN PREVENTION OF CRIME.
Abstract
THE AUTHOR STATES THAT SEVERAL GOVERNMENT OFFICIALS ARE NOW ADVOCATING A RETURN TO SEVERE AND MANDATORY PENALTIES FOR CERTAIN TYPES OF CRIME. THE VARIOUS AIMS OF PUNISHMENT ARE OUTLINED. THESE INCLUDE RETRIBUTION, GENERAL DETERRENCE, SPECIAL DETERRENCE, AND INCAPACITATION OF OFFENDERS. THE AUTHOR CONTENDS THAT THE MOST EFFECTIVE REFORM WOULD BE THE ELIMINATION OF DELAY IN THE JUDICIAL PROCESS. IN THIS WAY, THE CRIMINAL PENALTY WOULD BE MORE EFFECTIVELY RELATED TO THE COMMISSION OF THE CRIME.
