ANALYSIS OF THE HISTORICAL DEVELOPMENT FROM 1896 TO 1964 OF THE SYSTEM OF PROCEDURAL RULES GOVERNING THE PROCESS LEADING UP TO THE DECISION TO CHARGE THE DEFENDANT.
Abstract
THE ARTICLE FOCUSES ON THE QUESTION OF WHETHER THE DEFENDANT'S RIGHTS ARE PROPERLY PROTECTED BY THE VARIOUS PROCEDURES. THE ASSESSMENT IS BASED ON STATISTICS ON THE DISPOSITION OF CASES AS FAR BACK AS 1914. A MAJOR CONSIDERATION THROUGHOUT IS THE EFFORT TO DEVELOP PROCEDURES TO REDUCE THE NUMBER OF CASES WHICH COME TO TRIAL UNNECESSARILY. THE AUTHOR RECOMMENDS THAT THE BILL OF INDICTMENT BE MADE AVAILABLE TO THE DEFENDANT AT THE TIME HE IS CHARGED IN ORDER TO EXPEDITE ANY PROCEDURAL OBJECTIONS HE MAY HAVE. --IN FRENCH.
