THIS CRITICAL ANALYSIS OF THE EXISTING SENTENCING STRUCTURE AND ITS EFFECTS DISCUSSES THE PURPOSES THAT MIGHT BE SERVED BY IMPOSING CRIMINAL SANCTIONS AND SUGGESTIONS FOR CURBING SENTENCING DISPARITY.
Abstract
THE SANCTIONING RATIONALES REVIEWED ARE REHABILITATION, DETERRENCE, INCAPACITATION, AND PUNISHMENT. SENTENCING REFORM SUGGESTIONS INCLUDE REDUCING JUDICIAL DISCRETION THROUGH DETERMINATE SENTENCES, ESTABLISHING ADVISORY SENTENCING COUNCILS, AND PROVIDING FOR APPELLATE REVIEW OF SENTENCES.
