BRIEF OVERVIEW OF THE NATURE AND LEVEL OF JUVENILE CRIME IN WEST GERMANY AND OF THE TRENDS IN SANCTIONS AND TREATMENT PROGRAMS APPLIED BY THE WEST GERMAN JUVENILE JUSTICE SYSTEM.
Abstract
IN 1972 ONE THIRD OF ALL KNOWN OFFENDERS IN WEST GERMANY WERE UNDER 21 AND 7 PERCENT WERE UNDER 14. THE TREND IN THE DEVELOPMENT OF WEST GERMAN JUVENILE LAW IS TOWARD PROVISIONS FOR EDUCATION, TRAINING, AND TREATMENT AND AWAY FROM PUNISHMENT. A PROPOSED YOUTH ASSISTANCE LAW (JUGENDHILFEGESETZ) WOULD ELIMINATE JUVENILE SANCTIONS FOR 14 AND 15 YEAR-OLDS AND PROVIDE THEM FOR 16 AND 17 YEAR-OLDS ONLY IN THE CASE OF SERIOUS OFFENSES OR WHEN TREATMENT PROGRAMS HAVE NOT BEEN SUCCESSFUL. --IN GERMAN
