THIS COMMENT DISCUSSES THE POSSIBILITY OF REQUIRING THAT JUVENILES BE ADVISED OF THEIR RIGHT TO SEE THEIR PARENTS FOR AID AT OR DURING CUSTODIAL QUESTIONING.
Abstract
THE AUTHOR ANALYZES THE APPROACHES TAKEN BY VARIOUS COURTS WHEN DEALING WITH THE PROBLEMS OF JUVENILE INTERROGATION, THE PROTECTION A RIGHT TO A PARENT'S PRESENCE MAY PROVIDE, THE ARGUMENTS AGAINST THE EXISTENCE OF THIS RIGHT, AND THE CONSTITUTIONAL BASIS OF THE RIGHT. THE TOPIC IS DEVELOPED THROUGH AN EXAMINATION OF EXISTING CONSTITUTIONAL RESTRAINTS ON THE INTERROGATION PROCESS AND OF THE APPLICATION OF THE CONSTITUTION TO JUVENILES. (AUTHOR ABSTRACT)
